New HIPAA Publication: Medical Privacy of Protected Health Information

A new publication entitled "Medical Privacy of Protected Health Information" by CMS was recently released. This 2 page document should be read by all providers. It does a great job of clarifying some key questions asked by health care offices.

The following key points are discussed:

  • HIPAA does not require patients to sign consent forms before doctors, hospitals, or ambulances can share information for treatment purposes
  • HIPAA does not require providers to eliminate all incidental disclosures
  • HIPAA is not anti-electronic
  • HIPAA does not cut off all communications between providers and the families and friends of patients
  • HIPAA does not stop calls or visits to hospitals by family, friends, clergy or anyone else
  • HIPAA does not prevent child abuse reporting
